Introduction and Acceptance of Terms
By accessing or using our real estate platform (including our website and any related services), you agree to be bound by these Terms of Use, as well as our Privacy Policy. Please read these terms carefully. If you do not agree with any part of these terms, you must immediately cease using our platform. We reserve the right to update or change these terms at any time by posting revised terms on our website. Your continued use of the platform after changes are posted constitutes your acceptance of the updated terms.
Accounts, Eligibility, and Security
To use certain features (such as listing a property or accessing an agent dashboard), you may need to create an account. Eligibility: You must be at least 18 years old and residing in Australia to create an account or use our services. Our platform is intended for Australian users only, and we do not actively offer services to users outside Australia. By creating an account, you represent that the information you provide is truthful and accurate, and that you have the legal capacity to enter into this agreement.
When you register, you are responsible for maintaining the confidentiality of your login credentials. Account Security: You must keep your username and password secure and not share them with others. You are liable for all activities that occur under your account, whether or not authorized by you. If you become aware of any unauthorized use of your account or breach of security, you must notify us immediately. We are not liable for any loss or damage arising from your failure to adequately safeguard your account credentials. We may suspend or terminate accounts that we suspect are being used in violation of these terms or any applicable law.
Listing Properties – Agent and Contributor Obligations
If you are a real estate agent, property owner, or other authorized party using our platform to list properties or manage listings and leads, this section applies to you. By listing a property on our site, you agree to the following:
- Authority to List: You certify that you are the property owner or have obtained all necessary authority from the owner to list and market the property on our platform. You must have a valid agency agreement or permission to act on behalf of the seller/landlord for the property you are listing.
- Accuracy of Information: You represent that all information you submit about a property (including but not limited to price, location, features, and descriptions) is true, accurate, and not misleading to the best of your knowledge. You must promptly update or correct any information that you discover to be incorrect or outdated.
- Content Rights and Permissions: By uploading or providing any photographs, images, floor plans, descriptions, or other content (“Listing Content”), you confirm that you own the intellectual property rights in that content or have obtained the necessary licenses and permissions to use it. You must have the right to publicly share any photos, images, or data you provide. Prohibited Content: You will not upload any content that infringes the rights of others, or that is illegal, defamatory, obscene, or otherwise violates any applicable law or regulation.
- Legal Compliance: You agree to comply with all applicable laws and regulations when listing a property, including Australian Consumer Law (e.g. no false or misleading claims) and any state/territory real estate advertising rules. All listings must reflect actual available properties and truthful details. You must not include any discriminatory, offensive, or otherwise unlawful statements in your listings.
- Listing Management: Agents are responsible for managing their listings and leads through their dashboard. Any leads (e.g. inquiries from potential buyers or renters) received through our platform should be used solely for the purpose of responding to that inquiry and providing real estate services to that potential client. You agree to handle any personal information of leads in accordance with privacy laws and our Privacy Policy. Spam or unsolicited marketing to people who inquire via our platform is strictly prohibited.
- Right to Remove or Edit: We reserve the right to refuse, edit, or remove any property listing that, in our sole discretion, violates these terms or any applicable law, or for any other reasonable cause (for example, if we receive a complaint or if the listing content is inappropriate, offensive, or inaccurate). We may remove or disable access to any of your content at any time without liability to you.
By listing content on our site, you grant us certain rights to that content as described in the Intellectual Property section below, so that we can display and promote your listings.
Acceptable Use of the Platform
We are committed to providing a reliable and fair platform for all users. You agree to use our platform only for its intended purposes (e.g. searching for property listings, posting listings, managing leads) and in accordance with these terms. When accessing or using our platform, you agree NOT to:
- Scrape or Data Mine: Use any automated device, script, web crawler, scraping software, robot, or other automated means to access, retrieve, index, or collect data or content from our website without our prior written permission. This includes prohibiting the use of bots to harvest listing information, user information, or any other data from the site.
- Interfere with Platform Functionality: Attempt to interfere with the proper working of our website or services. You must not deploy any device, software, or routine (including any viruses, worms, or harmful code) that could interfere with the functionality or security of our platform. Similarly, you agree not to undertake any action that imposes an unreasonable or disproportionately large load on our infrastructure (for example, launching a denial-of-service attack or other excessive traffic generation).
- Bypass Access Controls: Attempt to bypass, disable, or otherwise circumvent any measures we use to prevent or restrict access to the platform, such as attempting to access areas or features you are not authorized to use.
- Prohibited Uses: Use the platform for any unlawful or fraudulent purpose, or to solicit others to perform or participate in any unlawful acts. You must not post or transmit any material that is illegal, harassing, defamatory, obscene, offensive, or otherwise objectionable or that violates any person’s rights (including intellectual property, privacy, and publicity rights). Impersonating any person or entity, or misrepresenting your affiliation with any person or entity, is forbidden.
- Misuse Content or Data: Reproduce, copy, modify, adapt, distribute, or publicly display any content from our platform outside of its intended use, except as allowed by law or with our explicit consent. In particular, you must not use our listing data or other content to create or augment your own databases or competing products and services. For example, you are not permitted to systematically download our property listings to populate another real estate website or service.
- Spam and Unsolicited Communications: Transmit or send any unsolicited advertising, promotional materials, junk mail, chain letters, or spam through our platform. If our platform allows you to communicate with other users (such as an agent contacting a prospective buyer), you agree to use such functionality only for legitimate purposes related to real estate and not for sending unrelated marketing messages.
Violation of any of the above acceptable use rules may result in immediate suspension or termination of your access to the platform, removal of offending content, and/or legal action where appropriate.
Intellectual Property Rights
Our Content: Unless otherwise indicated, we (or our licensors) own all rights, title, and interest in the content and materials on our platform. This includes the website’s design, text, graphics, logos, button icons, images, compilations of listings, and software (collectively, “Platform Content”). This content is protected by copyright, trademark, and other intellectual property laws. You are authorized to use the Platform Content only for personal use in connection with the legitimate use of our services. You may not copy, reproduce, redistribute, or create derivative works from our Platform Content without our prior written permission, except as permitted by law (such as fair dealing under the Copyright Act). Any unauthorized use of Platform Content may violate intellectual property laws and these terms.
Your Content (User Contributions): In these terms, “Contributions” refers to any content that you submit or contribute to our platform, including property listings, descriptions, photographs, data, comments (if applicable), or other materials. You retain ownership of all intellectual property rights in your Contributions. However, by submitting or posting Contributions on our platform, you grant us a broad license to use them so we can operate and promote the service. Specifically, you grant us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, and transferable license to use, reproduce, distribute, adapt, modify, translate, publicly display, and perform your Contributions on or in connection with our platform and services. This license extends to allowing us to sub-license these rights to affiliates or service providers as needed to provide the service. You also agree that we may use the name or username you submit in connection with your content (for example, to attribute a property listing or review to you).
Additionally, you grant each user of our platform a non-exclusive license to access and view your Contributions through the platform (for example, visitors can view your property listing details and photos). This license for other users is limited to personal use as part of our platform’s normal functionality (so, for instance, a user can view and save your listing for their own use, but cannot reproduce it elsewhere for commercial purposes).
By providing any Contributions, you represent and warrant that: (a) you own or control all necessary rights to the content, or have obtained all necessary permissions (including from the photographer, author, etc.) to grant the licenses and rights set forth in these terms; and (b) our exercise of the license rights above will not infringe or violate any third-party rights. You also warrant that your Contributions do not contain anything that is unlawful, misleading, or harmful to others (for example, your content should not infringe someone’s copyright or trademark, should not include personal information about someone without consent, and should not be false or deceptive). We do not have an obligation to pre-screen or monitor user Contributions, but we reserve the right to do so and to remove or edit any Contributions at our discretion. We are not responsible for any loss of data or content you submit, so please keep your own backups of any important material.
If you believe content on our platform infringes your intellectual property rights, please notify us via the contact information provided so we can investigate and address the issue.
Third-Party Content and Data Accuracy
Our platform may include content or data provided by third parties or obtained from external sources (“Third-Party Content”). For example, some property details might be supplied by property data providers, real estate agents, or other third-party services. We might also display information that is automatically generated or inferred by our systems – for instance, our platform could use AI or compare similar properties to estimate certain features of a listing (e.g. assuming that units in the same building share amenities like a pool). All such Third-Party Content and auto-generated information is provided “as is” for your convenience, and we do not guarantee its accuracy or completeness. Representations made in Third-Party Content are those of the respective third party and not of us. We do not endorse, verify, or independently audit third-party or inferred information.
You should always independently verify important information before relying on it. For example, before you make a purchase or rental decision, you should confirm property details (such as availability, features, zoning, measurements, fees, etc.) with the listing agent or by obtaining professional inspections or advice. No Professional Advice: Information on our platform is of a general nature and is provided for informational purposes only; it should not be considered a substitute for professional advice (such as legal, financial, or real estate advice tailored to your situation).
While we strive to keep all property listings and data up to date, we do not warrant that any content (including property listings, pricing, or statistics) is current or error-free. Property availability and prices may change at any time without notice. We make no warranty that the platform’s content, including Third-Party Content, is free from errors or omissions, and we disclaim all liability for any errors or inaccuracies in the information provided. If you spot an inaccuracy, please contact us so we can correct it.
Privacy and Data
Your use of our platform is also subject to our Privacy Policy (available on our website), which explains how we collect, use, and protect your personal information. By using the platform, you consent to the collection and use of information as outlined in our Privacy Policy. In particular, if you are an agent or property lister, you agree to treat any personal information you obtain through the platform (for example, contact details of people who inquire about your listings) in accordance with applicable privacy laws. You may use such information only for the purpose for which it was provided (i.e. facilitating a real estate transaction or inquiry) and not for unsolicited marketing. We will handle your personal information in compliance with the Australian Privacy Act 1988 (Cth) and other relevant laws. For more details, please review our Privacy Policy.
No Warranties (Site Provided “As Is”)
Use at Your Own Risk: You acknowledge that your use of the platform is at your sole risk. To the maximum extent permitted by law, our services and all content on the platform are provided on an “as is” and “as available” basis. We make no representations or warranties of any kind (express or implied) about the accuracy, reliability, suitability, or availability of the platform or any content on it. We do not guarantee that the platform will be uninterrupted, timely, secure, or error-free. Any reliance you place on information from the platform is strictly at your own risk.
We specifically disclaim any warranties or conditions of merchantability, fitness for a particular purpose, non-infringement, and any warranties that may arise by course of dealing or usage of trade. While we endeavour to maintain a high quality of service, we cannot promise that the site will always be free of technical errors, delays, or viruses. It is your responsibility to use up-to-date antivirus and security software on your devices.
If you are a consumer as defined under Australian Consumer Law, you may have certain rights and remedies that cannot be excluded or limited by contract. Nothing in these Terms of Use is intended to exclude, restrict, or modify any rights you have under the Competition and Consumer Act 2010 (Cth) or other applicable consumer protection laws that cannot be lawfully excluded. This means you may be entitled to certain guarantees (such as that services are carried out with due care and skill) which we cannot contract out of. To the extent we are able to limit a remedy for a breach of such a guarantee, we expressly limit our liability as set out in the Liability section below.
Limitation of Liability
To the extent permitted by law, in no event will we (and our officers, directors, employees, agents, or affiliates) be liable to you for any indirect, consequential, special, exemplary, or incidental damages arising out of or in connection with your use of the platform or these terms. This includes, without limitation, any loss of profits, loss of business opportunity, loss of goodwill, loss of data, or other intangible losses, even if we have been advised of the possibility of such damages. You acknowledge that the platform is made available to you for personal use and we bear no responsibility for any commercial or financial losses you might incur by relying on it.
Our total aggregate liability to you for all claims arising from or related to the platform or these terms will be limited, to the extent permitted by law, to either: (a) the resupply of the relevant services or content to you; or (b) the cost of resupplying the services or content to you. In jurisdictions where limitation of liability for certain damages is not permitted, our liability will be limited to the smallest amount permitted by law.
Indemnity: You agree to indemnify and hold us (and our related entities, officers, employees, and agents) harmless from any claim or demand, including reasonable legal fees, made by any third party due to or arising out of your breach of these terms, your violation of any law or rights of a third party, or your use of the platform in violation of these terms. In other words, if your conduct or content on our site causes us to face a legal claim or incur costs (for example, a lawsuit alleging that a listing you posted infringes someone’s copyright or was misleading), you agree to cover our costs and losses to the extent that you caused them. We will notify you of any such claim and may require your cooperation in defending it. This indemnity obligation will survive termination of your account or these terms.
Suspension, Termination, and Breach
We reserve the right to suspend or terminate your account or access to our platform at any time if you breach these terms, violate any law or regulation, or misuse the platform in any way. We may also remove any of your listings or content, or disable access to certain features, without prior notice if we determine, in our sole discretion, that it is necessary to protect our platform or other users. For example, we might immediately suspend an agent’s account that is found to be posting fraudulent listings, or remove content that we receive a legitimate complaint about. In serious cases or repeat violations, your account may be terminated and you may be barred from creating a new account.
If your account is terminated, these Terms of Use will also terminate, except for any provisions that by their nature should survive (such as intellectual property rights, disclaimers, limitations of liability, indemnities, and governing law). Termination of your access or account will not limit any other rights or remedies we may have at law or in equity.
You are free to stop using our platform at any time. If you wish to delete your account, you may contact us or use any self-service account deletion feature if available. Note that content you have provided (such as property listings) may continue to exist on our platform or backups for a reasonable period or as required by law, even after deletion, but it will no longer be visible to other users (subject to our data retention policies).
Future Features and Paid Services
Free Services (No Fees Currently): At present, our platform is provided to you free of charge. There are no fees for basic usage, such as browsing listings or standard agent listing functionality. However, we reserve the right to introduce new features, premium services, or subscription offerings in the future which may require payment. For example, we may offer enhanced advertising options, special promotional placements for listings, or other value-added services for a fee at a later date.
If we decide to roll out any paid features or services, we will provide clear information about any fees or charges and the terms that apply to those services. You will not be charged for any service unless you have opted in or agreed to a fee (e.g. by purchasing a premium listing package). We may update these Terms of Use or provide separate additional terms to cover any new paid features. You will have the opportunity to review those terms and accept any fees before using the paid service.
Governing Law and Jurisdiction
This agreement (and any non-contractual disputes or claims arising out of or in connection with it or your use of the platform) is governed by the laws of Queensland, Australia, excluding its conflict of law principles. By using our platform, you submit to the exclusive jurisdiction of the courts of New South Wales for resolving any disputes that may arise, and you waive any objection to the venue of those courts. If you are using the platform in another Australian state or territory, you will also be entitled to the protections of the consumer laws in that jurisdiction, but these terms remain governed by NSW law for consistency.
General
If any provision of these terms is found to be invalid or unenforceable by a court of competent jurisdiction, that provision will be severed from the terms and the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision of these terms does not constitute a waiver of that right or provision. These Terms of Use, together with our Privacy Policy and any additional terms you agree to when using particular services (if any), constitute the entire agreement between you and us regarding your use of the platform, superseding any prior agreements or communications.
Any notices to you may be made by email or by postings on our website. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.
